On August 25, 2026, the City of Niagara Falls distributed a Notice of Passing concerning By-law No. 2026-073 and amendments to its Community Improvement Plan. The notice advised potential appellants that an Ontario Land Tribunal appeal required a filing fee of $1,100, potentially reducible to $400.
After checking the OLT’s official fee chart and confirming the information directly with an OLT representative, I determined that this specific type of Planning Act appeal carried no filing fee. On August 31, I submitted the following Public-Interest Correction Request to the City, copied to City Council, the Ontario Ombudsman and interested media recipients.
My submission requested an immediate correction, clarification of the appeal deadline, protection for anyone who may have been discouraged by the incorrect fee information, accessible publication of the adopted materials, and an explanation of how the error occurred.
